Terms of Service

These terms govern use of the Market Qwik platform at marketqwik.com. By creating an account you accept them on behalf of the business you register.

1. Early access and pricing

• Accounts are currently free. No credit card is requested and no trial period expires.
• Plan prices are published on the pricing page. Billing has not started. Before any charge applies we will give existing account holders at least 30 days' notice and the choice of plan, including the choice to close the account.
• Prepaid credits for AI features are optional, non-refundable once consumed, and governed by the spend cap you set.

2. Included enrichment and fair use

• Enrichment from the platform business pool, public website data and the built-in email verifier is included with your account at no per-record charge.
• Fair use applies. We may rate-limit, throttle or pause enrichment for an account whose volume or pattern degrades the service for other customers or places unreasonable load on third-party websites. We will tell you when this happens.
• Plan allowances are published on the pricing page and shown with your live usage on the billing page. They are not enforced during early access; enforcement starts with paid plans.
• Paid providers you connect (Hunter.io, Apollo.io, People Data Labs, Clearbit and others) are governed by your agreement with that provider, who bills you directly.

3. Your responsibilities when sending

• You are the sender of every campaign you launch. You must comply with the laws that apply to you and your recipients, including CAN-SPAM, CASL, GDPR and PECR, and with the acceptable-use rules of any sending provider you connect.
• You must not remove or disable the unsubscribe link or List-Unsubscribe headers we add, and you must keep a valid postal address in Settings → Compliance.
• You must only import or upload contact data you have the right to use.
• Prohibited: deceptive subject lines or headers, sending to purchased consumer lists, phishing, malware, harassment and any content that is unlawful where it is sent or received.
• We may restrict or suspend sending when bounce or complaint rates breach our thresholds or when we receive abuse reports.

4. Compliance tooling is not legal advice

Compliance presets, grading, suppression lists and similar features help you follow good practice. They do not establish consent, lawful basis or legal compliance on your behalf. Obtain your own legal advice.

5. Data

You own the data in your workspace. We process it to provide the service as described in the Privacy Policy. Business records in the shared platform pool are derived from public sources and your imports; you grant us a licence to keep de-duplicated business-level records (not your private notes, campaigns or engagement data) in that pool.

6. Accounts and security

• Keep your credentials confidential. You are responsible for activity under your account.
• The workspace owner controls access for other users and for client-portal users.
• Do not probe, scan or test the platform's security without written permission.

7. Availability and changes

The service is provided as is during early access. Some features are marked in development and may change or be withdrawn. We aim for high availability but do not offer a service-level agreement yet.

8. Termination

You may close your account at any time; export your data first. We may suspend or terminate accounts that breach these terms, with notice where practicable.

9. Liability

To the extent permitted by law, Market Qwik is not liable for indirect or consequential loss, and total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
